These Regulations set out the rules for the use of the Online Store, in particular, the rules for the conclusion of contracts for the sale of goods in the range of the online store through the online store, the rules for the performance of these contracts and the rules of the complaint procedure. All goods in the assortment of the Online Store are brand new..

I. Definitions


The terms used in the Regulations shall mean:

1.customer (entrepreneur)- a natural person, legal entity or unincorporated entity intending to purchase, purchasing or who has purchased goods offered by the Store in the course of its business;

2.civil Code - the law of April 23, 1964. (OJ. U. No. 16, pos. 93 as amended.);

3.regulations - these Regulations for the provision of electronic services within the framework of the Hurt online store.TimeNabuty.pl;

4.online store (Store) - Internet service available at www.wholesale.timenabutes.pl, through which the Customer may, in particular, place Orders;

5.goods - products presented in the Online Store;

6.sales contract - a contract of sale of Goods within the meaning of the Civil Code, concluded between Shelovet Sp. featuring.o. and the Customer, concluded using the Store's website;

7.law on the provision of services by electronic means - the law of July 18, 2002. on the provision of services by electronic means (Dz. U. No. 144, item. 1204 as amended.);

8. RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation);

9.order - a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.

II. General provisions


1. These Regulations set out the rules for the use of the online store available at www.wholesale.timenabutes.en.

2. These Regulations are the regulations referred to in Art. 8 of the Law on Provision of Electronic Services.

3. Online store, operating at www.wholesale.timenabutes.pl, is operated by Shelovet Sp. featuring.o. 17 Lotników Alianckich Street, 68-100 Żagań, POLAND (NIP: 5482743706, REGON: 522010632)

4. These Regulations specify in particular:
a.) the rules for registering and using an account within the online store;
b.) terms and conditions for making electronic reservations for products available through the online store;
c.) terms and conditions for placing electronic orders within the online store;
d.) the rules for the conclusion of sales contracts using the services provided by the online store.

5. The use of the online store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
a.) having a computer or other multimedia device with access to the Internet;
b.) a web browser that supports HTML, CSS, JavaScript standards
c.) javascript enabled
d.) cookies enabled.

6. Customers may access these Terms and Conditions at any time through the link provided on the home page of the website.wholesale.timenabutes.pl and download it and make a printout of it. The regulations are also available at the Company's headquarters.

7. Information about goods provided on the store's website, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, as defined in Art. 71 of the Civil Code.

III. Rules of use of the Online Store


1. The condition to start using the Online Store is to register and create a customer account in the wholesale store.

2. Registration is done by completing and accepting the form provided on one of the store's pages.

3. The condition for registration is confirmation of familiarization with the provisions of these Regulations and consent to the processing of personal data.

4. Shelovet Sp. featuring.o. may deprive the Customer of the right to use the online store, as well as may restrict its access to part or all of the resources of the online store, with immediate effect, if the Customer violates the provisions of these Regulations, and in particular if the Customer:
a.) provided data during registration in the online store that is untrue, inaccurate or outdated, misleading or violates the rights of third parties,
b.) committed violations of the personal rights of third parties through the online store, in particular the personal rights of other customers of the online store,
c.) will engage in other behavior that will be recognized by theShelovet Sp. featuring.o. for behavior that is inconsistent with applicable law or the general rules of Internet use or harms the good name ofShelovet Sp. featuring.o.

5. A person who has been deprived of the right to use the online store may not register again without prior consentShelovet Sp.featuring.o. , expressed in a separate statement.

6. To ensure the security of the transmission of messages and data in connection with the services provided on the website, the online store takes technical and organizational measures appropriate to the degree of security risk of the services provided, in particular, measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.

7. In particular, the customer is obliged to:
a.) not to provide or transmit content that is prohibited by law, such as content that promotes violence, is defamatory or violates the personal rights and other rights of third parties,
b.) to use the Online Store in a manner that does not interfere with its operation, in particular through the use of specific software or devices,
c.) not to take actions such as: sending or posting unsolicited commercial information (spam) within the Internet Store,
d.) use the Online Store in a manner that is not burdensome to other Customers and to theShelovet Sp. featuring.o.
e.) use any content posted within the Online Store only for your own personal use,
f.) use of the Online Store in a manner consistent with the provisions of the laws in force on the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general rules of Internet use.

IV. The procedure for concluding a sales contract


1. In order to conclude a contract of sale through the online store, one should visit the website www.wholesale.timenabutes.pl, make a selection of goods and their colors from the Store's offer, taking further technical actions based on messages displayed to the Customer and information available on the site.

2. The selection of the ordered goods by the customer is made by adding them to the shopping cart.

3. During the ordering process, the Customer has the possibility to modify the entered data and in the selection of Goods. To do so, follow the messages displayed to the customer and the information available on the website.

4. After the customer using the online store has entered all the necessary data, a summary of the placed order will be displayed. The summary of the order placed will include information on:
a.) of the subject of the contract,
b.) of the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
c.) of the selected payment method,
d.) of the selected delivery method,
e.) of the expected delivery time.

5. In order to send an order, it is necessary to confirm that you have read the Terms and Conditions and agree to the processing of personal data provided in the registration form marked as mandatory and press the "order and pay" button.

6. The sending of an order by the customer constitutes a declaration of intent to conclude withShelovet Sp. featuring.o. sales contract, in accordance with the content of the Regulations.

7. After the order is placed, the customer receives an email containing the final confirmation of all important elements of the order.

8. The contract shall be considered concluded upon receipt by the Customer of the e-mail mentioned above.

9. The contract of sale is concluded in the Polish language, with the content in accordance with the Regulations.

10. Personal data is used only for order processing and, subject to the Customer's separate consent, for the processing of his/her personal data for marketing purposes in order to inform about new products, services and promotions offered by the web store.wholesale.timenabutes.pl and will not be shared with others except with authorized entities. The customer has the right to request from the controller access to personal data, the right to rectify, erase or restrict processing, the right to object to processing, as well as the right to data portability; I have the right to lodge a complaint with the DPA when it is substantiated that my personal data is processed by the controller contrary to the General Data Protection Regulation of April 27, 2016. Entrusted personal data shall be stored with rules and safeguards in accordance with the requirements set forth in the applicable laws of the Republic of Poland, including:

  • Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation);
  • Act of 29.08.1997. on the protection of personal data (Dz. U. 2016 pos.922, as amended. zm.);

    V. Delivery

    1. Delivery of Goods is made to the address indicated by the Customer when placing the order.

    2. Deliveries of ordered goods are made via courier service.

    Delivery costs are listed on page : DELIVERY COSTS. In addition, the date and cost of delivery will be indicated at the time of ordering.

    Recording, securing, making available and confirming to the Customer the significant provisions of the contract of sale of goods is carried out by sending the Customer a confirmation to the provided e-mail address and by attaching to the parcel containing the goods a printout of the confirmation of sale, i.e. a VAT invoice.

    VI. Prices and payment methods

    1. Prices of goods are given in Polish zloty and include all components, including the current rate of VAT.

    2. The customer has the option to pay the price:
    a.) by bank transfer to the bank account numberPL40105010701000009081637002,
    b.) in person in cash when picking up the goods from the courier company employee,
    c.) payment by payment card processed through Przelewy24 or PayU,
    d.) in person in cash at the Company's headquarters.

    VII. The right to withdraw from the contract

    1. If the buyer is not a consumer within the meaning of Art. 221 of the Civil Code, the store provides a 30-day pre-sale warranty. After-sales warranty is not provided. 

    VIII. Newsletter

    1. Service: SMS Newsletter and E-mail Newsletter is provided by:Shelovet Sp. featuring.o. 17 Lotników Alianckich Street, 68-100Żagań (NIP: 5482743706, REGON: 522010632).

    2. Under the E-mail Newsletter service, information in the form of an electronic letter (e-mail), hereinafter referred to as "Newsletter", is sent by e-mail to the electronic mail address (e-mail address) provided by the User. Newsletter service is provided free of charge for an indefinite period of time. Newsletter contains information about the offer of products offered by the online store and current promotions.

    2.(1) By subscribing to the E-mail Newsletter, the user consents to the processing of his personal data in the following scope: e-mail address for the purpose of sending the E-mail Newsletter byShelovet Sp. featuring.o.headquartered at 17 Lotników Alianckich Street, 68-100 Żagań. He/she knows that his/her personal data will be kept until he/she revokes his/her consent to processing for marketing purposes. The consent granted may be withdrawn at any time by sending an email to: rodo@czasnabuty.en. Knows that he/she has the right to request access to personal data from the controller, the right to rectify, erase or restrict processing, the right to object to processing, and the right to data portability; has the right to lodge a complaint with the DPA when it is substantiated that his/her personal data is being processed by the controller in violation of the General Data Protection Regulation of April 27, 2016. Is aware that providing personal data is voluntary, however, failure to provide data to the extent required by the administrator makes it impossible to use the E-mail Newsletter service.

    3. Within the SMS Newsletter service, information in the form of a text message, hereinafter referred to as "SMS Newsletter", is sent via a cell phone to the phone number provided by the User. SMS Newsletter service is provided free of charge for an indefinite period of time. The newsletter contains information about the offer of products offered by the online store and current promotions, as well as links to the website maintained under the domain: www.wholesale.timenabutes.en.

    3.(1) By subscribing to the SMS Newsletter, the user agrees to the processing of his/her personal data in the scope of: phone number for the purpose of sending the SMS Newsletter byShelovet Sp. featuring.o.headquartered at 17 Lotników Alianckich Street, 68-100 Żagań. He/she knows that his/her personal data will be kept until he/she revokes his/her consent to processing for marketing purposes. The consent granted may be withdrawn at any time by sending an email to: rodo@czasnabuty.pl, in which case his phone number will be removed from the ww. bases. Knows that he/she has the right to request access to personal data from the controller, the right to rectify, erase or restrict processing, the right to object to processing, and the right to data portability; has the right to lodge a complaint with the DPA when it is substantiated that his/her personal data is being processed by the controller in violation of the General Data Protection Regulation of April 27, 2016. Is aware that the provision of personal data is voluntary, however, failure to provide data in the scope required by the administrator makes it impossible to use the SMS Newsletter service.

    4. The use of the E-mail Newsletter and SMS Newsletter service is dependent on the User having a computer or other multimedia device with access to the Internet and on the User having a.

    IX. Complaints regarding the provision of electronic services

    1.Shelovet Sp. featuring.o. takes measures to ensure fully correct operation of the store, to the extent that results from the current technical knowledge, and undertakes to remove within a reasonable time any irregularities reported by customers.

    2. Irregularities related to the functioning of the Store, the Customer may report in writing to the address:Shelovet Sp. featuring.o. 17 Lotników Alianckich Street, 68-100Żagań or by email at wholesale@czasnabuty.pl or by using the contact form.

    3. In a complaint, the Customer should provide his/her name, company name, mailing address, type and date of occurrence of irregularities related to the functioning of the Store.

    4.Shelovet Sp. zo.o. undertakes to consider each complaint within 14 days, and if this is not possible, to inform the customer within this period when the complaint will be considered.

    X. Personal information and privacy policy. Information obligations.

    1. The personal data provided by the customer during the registration or ordering process is processed by theShelovet Sp. featuring.o. with its registered seat at 17 Lotników Alianckich Street, 68-100 Żagań,, POLAND; entered in the Register of Entrepreneurs of the National Court Register by the District Court in Bielsko-Biała VIII Economic Department of the National Court Register under the KRS number 0000971522, having tax identification number NIP: 5482743706, REGON number: 522010632, which is the administrator of personal data.

    2. A necessary part of the procedure for creating an account and placing an order is for the Customer to provide his/her personal data, marked as mandatory, and to give his/her consent to the processing of his/her personal data provided during registration. Provision of personal data marked as mandatory is voluntary, however, it is necessary for the purpose of registration and order placement, order processing and service. Provision of personal data not marked as obligatory is voluntary.

    3. If the Customer has given separate consent for the service provided electronically, the subject of which is the free delivery of newsletters, the obtained electronic mail address (e-mail address) and telephone number is added to the mailing list and is used for marketing purposes to send the Customer commercial information electronically in the form of a Newsletter (E-mail Newsletter and/or SMS Newsletter), in accordance with point. VIII of these Regulations.

    4. Consent for the processing of personal data is given by checking the appropriate box on the form by the customer.

    5. Collected personal data are not shared with third parties, with the exception of the transfer of data to entities participating in the execution of the order in order to deliver the ordered goods to the Customer, i.e. DPD POLAND Sp. featuring.o. based in Warsaw, Poczta Polska S.A. or InPost Paczkomaty limited liability company based in Krakow. If payment for the ordered goods is made in advance or at the InPost Parcel Machine, the data are also transmitted to the entity through which the transaction is settled. The scope of data provided is limited to the necessary minimum, in accordance with the principle of minimization of personal data.

    6. The customer has the right to request from the controller access to personal data, the right to rectify, delete or restrict processing, the right to object to processing, and the right to data portability. The customer also has the right to lodge a complaint with the DPA when it is substantiated that their personal data is being processed by the controller in violation of the General Data Protection Regulation of April 27, 2016., referred to as "RODO"; For this purpose, he should contact the Company at the address: Shelovet Sp. featuring.o.  43-419 Hażlach 17 Lotników Alianckich St., 68-100 Żagań or rodo@czasnabuty.en.

    7. The customer has the right to obtain information on whether and to what extent his/her personal data are processed, as well as information on the purpose and scope of the processing of his/her personal data. For this purpose, he should contact the Company in the manner indicated in section 6 above.

    8. The Company, as the controller of personal data, may entrust another entity, by means of a written agreement, with the processing of personal data, subject to the provisions of Art. 28 RODO;

    9. The Company uses cookies, i.e. small text-number files that are saved by the ICT system in the User's ICT system (on the User's computer, phone or other device from which the connection with the Website was made) while browsing the Website, which allow for subsequent identification of the User in case of reconnection with the Website from the device (e.g. computer, phone), on which they were saved.

    10. Cookies collect data on the use of the Website by the User, and their main purpose is to facilitate the use of the Website by the User, adapt the Website pages to the needs and expectations of a given User (personalization of the Website subpages), study User traffic within the Website.

    11. Cookies are used on the Website with the consent of the User. Consent may be given by the User through appropriate settings of the software, in particular the Internet browser, installed in the telecommunications device used by the User to view the content of the Website.

    12. The Service User may also restrict or disable cookies in his/her browser at any time by setting it in such a way that it blocks cookies or warns the User before a cookie is stored on the device he/she uses to view the content of the Service. In such a case, however, it may happen that the use of the Service will be less efficient and the User will not be able to access some content, and in extreme cases the correct display of the pages of the Service may be completely blocked.

    XI. Final provisions

    1. In matters not covered by these Regulations, the provisions of the Civil Code shall apply.

    2. Settlement of possible disputes arising between Shelovet Sp. featuring.o. and a customer who is not a consumer within the meaning of Art. 221 of the Civil Code, shall be submitted to the court having jurisdiction over the seat of the Shelovet Sp. featuring.o.
